"Judiciously Empathetic" Thompson Nominated to 1st Circuit

Marc Comtois

President Obama has nominated O. Rogeriee Thompson to the U.S. Court of Appeals for the First Circuit. This is the same Judge Thompson, who, as Bob Kerr recently explained, "granted continuance after continuance as [Pocahontas] Cooley claimed various physical ailments or requested additional evidence..." in Cooley's attempt to take over former-boyfriend Paul Kelly's home. (Justin has written extensively about this case). In particular, the impression that emerges of Thompson is that of a judge showing a liberal amount of "judicial empathy" to Cooley and not so much to Kelly. As Justin detailed:

[Cooley's] first ploy was to demand thirteen subpoenas for information — some of which actually proved to support the case against her, and all of which Judge Thompson granted at taxpayer expense. During one subsequent appearance in court, Cooley insisted that she was awaiting subpoenaed information from the Pentagon, a clear impossibility. At other times, she challenged the reality of Kelly's deployment.

In December, she had the good fortune to fall on the way into the courthouse. In the intervening months, Ms. Cooley has appeared in court on a regular basis, each time finding ways to err in her attempts to prove that she is not physically capable of a hearing. While granting continuance after continuance, the judge has provided Cooley with further instructions on acquiring the proper doctor's note.

Meanwhile, Mr. Kelly is living in his sister's basement (without his dogs), awaiting his next chance, on May 29, to receive a hearing date at last. Judge Thompson rotates out of the county at the end of June, at which point she may either take the case with her or leave it for one of her peers — one more whim over which Kelly is powerless. Even more so is Thompson's potential elevation to federal court a variable in his fate.

One wonders if Thompson's recent finding that Kelly is in the right and that the home is indeed his own was prompted by word that she would, indeed, be so elevated.

The bleeding hearts are such transparent phonies. They don't care who they hurt, as long as they can fabricate the appearance of helping someone with a good sob story, whether it's true or false. Fake victims are the bread and butter of the left.

The same Ms Thompson who as Captain of the Brown Cheerleading Squad turned her back on the American Flag when the National Anthem was played?

Having had a lot of professional contact with Judge Thompson during my assignment with the Providence PD narcotics unit,I can only say her judicial temperament and professionalism are outstanding.
I never saw any "bleeding heart" behavior where criminals were concerned.
The judge most certainly is politically liberal and we can't expect Obama to appoint a political conservative to the Federal bench.I am unaware of this judge ever taking politics into the courtroom in any event, and for what it's worth she is about the least arrogant and most down to earth jurist I've run into. That is a quality sadly lacking in most Federal judges.
She has no ethical problems that have ever been mentioned or rumored. She hasn't been that politically active that I'm aware of.
This is not the fight conservatives should look for.She is probably one of the least damaging appointments Obama could make in this area.
I don't know the details of the Kelly case, but he eventually prevailed, thankfully. When one litigant is represented and the other isn't,judges are forced by circumstance to allow much more leeway than normal to the pro-se litigant in order to avoid reversal on appeal.
What she may have done on one occasion as a college student shouldn't be held against her all these years later. It wasn't like she was a Bill Ayers type trying to hurt people.
Many very conservative personalities were left wingers in their younger years.
Save the energy for opposing Jack McConnell-he is a political animal, giving close to $800,000 to the RI Democrat party over the last few decades.McConnell might as well hire Steven Brown as a law clerk(although Brown isn't an attorney)because he sounds like Brown on almost every issue. This man will politicize the bench from day 1.
I know many here might disagree with me on this but just consider what I'm saying for a minute.

A man was kept out of his own house for two years due to Ms. Thompson's abuse of the bench, Joe.

While we're on the subject, let's put on the table her motivation. No one has wanted to say it but it was reverse racism and convoluted historic justice. White men deprived Indians of their land for centuries; now we'll even things up a little.

Her handling of the Cooley-Kelly case should have gotten her thrown off the bench, not promoted.
